What the automatic stay generally does
When a bankruptcy case is filed, the automatic stay generally requires most creditors to stop collection activity. That can affect wage garnishments, a pending foreclosure sale, many collection lawsuits and creditor calls. The protection has exceptions and limits; Jeff reviews what it means for the particular action you are facing.
The stay does not cover everything. Certain matters, including child support collection and some criminal proceedings, are outside its general protection. Previous filings and the circumstances of a case can also matter. Do not rely on a general website description to decide whether a particular creditor must stop. Ask Jeff about the notice or action itself.
Wage garnishment and creditor lawsuits
If money is being taken from your paycheck, mention the garnishment when you first call. Identify the creditor, the notice and any dates you know. If you have lawsuit papers, identify the case and any upcoming deadline rather than assuming a bankruptcy inquiry replaces a response in that matter.
The review should also address the obligation behind the collection action. Stopping immediate pressure and dealing with the underlying debt are connected but distinct questions. Chapter 7 and Chapter 13 handle debt differently, so the recommendation depends on more than the fact that a creditor is collecting.
A pending foreclosure needs a timing discussion

Chapter 13 may offer a repayment approach for catching up on past-due mortgage payments, but the plan must be reviewed against your income and expenses.
